1 / Agreement and orders
These Terms cover our application, previews, Website Kit, ESL AI and separately ordered services. You must be at least 18 and authorised to submit business information and buy for the business. Provide accurate information and rights-cleared content. An application or booking is not a purchase. The accepted order identifies the specific scope, fees, renewals and cancellation terms. Specific written order terms control the affected service without removing mandatory rights.
2 / Preview and booking
The free offer is a functional wireframe, not a final public website. The 60-minute deadline begins only when a complete eligible application is accepted with capacity. Delivery means sending a checked preview URL through an authorised channel. The standard website build is free. Required hosting is $588/year, equivalent to $49/month billed annually, with no monthly billing option. First-year cost and annual hosting renewal are $588. Hosting is payable when the completed website is ready for public launch; launch requires payment and approval. Separately agreed upgrades and packages retain their own fees.
3 / Preview access
Unpaid previews are hosted for 72 hours from valid delivery because hosting costs us money. A confirmed call booked before the deadline protects access through that call and eligible reschedules. Cancellation without replacement restores the original window; attendance/no-show creates no new window. Late booking does not restore access automatically. Approved extensions and paid agency projects are protected. Expiry is distinct from record deletion. The preview is unlisted, not password protected. Anyone with its active link may view it. Supplied business information and rights-cleared content, including your supplied business website, are used solely to create and share this preview with you. Public launch or advertising use requires your approval; launch also requires paid hosting. A launch call is required without obligation to purchase.
4 / Agency services
The standard 15–25-page website includes mobile-friendly design, calls to action and forms, search and answer-engine foundations, accessibility features and toolbar, a website-information assistant and privacy/security foundations. Agency production, hosting, Pro, Care and managed plans are separate from the kit. Standard completion is within seven calendar days after launch confirmation, complete onboarding, required materials/access and approvals, with recorded client-dependent pauses. One consolidated revision round applies to standard/Pro; defects are corrected without treating them as an upgrade. Extra scope requires agreement. Applicable service-order terms and the disclosed seven-day post-launch satisfaction remedy apply; they do not extend to the DIY kit.
5 / Price and deliverables
The Website Kit costs US $47 once, plus taxes shown before payment. ESLAUNCH LLC supplies it; Whop processes payment under its terms. It includes one customized website-building prompt, the ebook and its integrated launch checklist. The prompt instructs a DIY website of up to 15 public pages including legal/informational pages. Fewer may be appropriate. We do not build or publish the website for you.
The $47 kit includes one customized website-building prompt per verified purchase and the ebook with its integrated checklist. A successful saved generation consumes that purchase's generation. Retrieval does not create another generation. Separate third-party costs and buyer review/publication duties remain.
6 / Defined access period
ESL AI and hosted ebook/saved-prompt access are provided for 12 months beginning when verified payment has been received and usable access has been successfully provided to your checkout email. That start date and expiry are shown in your account. One successful saved prompt consumes the purchase's one generation; copying or downloading it does not. Redeem the generation during this period. No automatic renewal or lifetime access is included.
Delivery interruption
If a verified delivery/access failure prevents use, we will restore access and preserve the purchased period by adjusting its start or extending it for the verified interruption. We will not treat a failed generation as consumed. Requests about material failures remain subject to applicable rights and the refund policy.
7 / Downloads and permitted use
You may keep downloaded ebook and prompt files for your own business use after portal access ends. Your personal, non-transferable licence to those copies continues unless lawfully terminated for material misuse; ongoing hosting, support, updates or further generations are not included. Do not resell or redistribute the ebook, reusable templates or access credentials. You retain rights in your supplied content; third-party platform and applicable output rights also apply.
8 / Separate costs and limits
Lovable usage, domains, hosting and integrations are separate. You review facts, rights, forms, accessibility, privacy and security and arrange launch in your own account. A prompt does not guarantee a completed website, legal compliance, traffic, leads or revenue. Access support is available at support@eslaunch.com; custom website building, legal advice and unlimited human revisions are excluded.
9 / Hosting and agency satisfaction
Standard agency hosting is $588/year, billed annually and first payable when the completed website is ready for approved public launch. We provide approximately 14 days' renewal notice and a seven-day unpaid-renewal grace period. Eligible standard/Pro dissatisfaction requests submitted within seven calendar days after final public launch refund first-year hosting actually paid for the free standard build; separately purchased packages follow their applicable orders and refund eligible build and hosting actually paid, end the purchased website service and take it offline; processing expectation is 14-28 business days. Managed plans follow their orders.
10 / Ownership and exit
You retain your domain and supplied content. Agency website use requires active ESLaunch hosting unless expressly agreed otherwise; proprietary templates, infrastructure and automations are not automatically transferred. Reasonable domain handoff help is included within the stated scope; broader export/migration depends on platform support and separately agreed work. These rules do not govern hosting you purchase directly for a DIY site.
11 / Responsible use and third parties
Do not submit malware, secrets, private customer lists or unnecessary sensitive data. Do not impersonate others, share protected access or attack the service. We may proportionately restrict abusive access, preserving purchased and mandatory rights. Third-party platforms have separate terms and may change; we do not promise uninterrupted service or immunity from security incidents. We remain responsible for our own express commitments and legal obligations.
12 / Accessibility, results and communications
Accessibility features supplement accessible development and are not legal certification. No ranking, lead or revenue guarantee applies. Marketing permission is separate and is not required to buy. Use unsubscribe controls or STOP for permitted marketing messages, and contact support for assistance. Your business-specific legal obligations remain your responsibility.
13 / Updates, remedies and contact
Material changes apply prospectively with any required notices; they do not remove earned remedies or shorten purchased access retroactively. Nothing limits liability or remedies that cannot be limited by law. No forced arbitration, blanket liability exclusion or choice-of-law waiver is introduced here. Contact support@eslaunch.com for service, privacy, accessibility or refund requests.
Website Kit refund policy
Change-of-mind requests
We do not offer change-of-mind refunds after you have downloaded or accessed the ebook, or successfully generated your customized prompt, except where required by law. Before either event, you may request cancellation within seven calendar days after purchase. Eligibility is based on actual access/generation records, not the mere sending of an email. We may offer a discretionary remedy beyond this policy; doing so does not change other purchases.
Delivery failures and defects
Email support@eslaunch.com with the checkout email, order reference and a description of the problem. Do not send card details or passwords. We investigate missing access, unusable files, failed generation and material differences from the description. We will provide access, repair or replace the affected deliverable, or refund as appropriate. If we cannot provide the promised functional kit within ten business days after receiving sufficient details, we will refund the kit purchase unless you choose another remedy. Any earlier remedy required by law applies.
Duplicate and unauthorised payments
Report duplicate payments so we can verify and reverse the duplicate charge. For suspected unauthorised charges, contact us, Whop or your payment provider promptly. This policy does not restrict card-issuer disputes, Whop payment remedies or legal rights; contacting us first is a request, not a condition on those rights.
Processing and preservation of rights
Approved refunds are sent to the original payment method through the processor; bank posting time varies. Full kit refunds end that purchase's portal access and licence to the refunded kit materials, to the extent lawful. Separate agency purchases and your own business content are unaffected. This policy does not exclude remedies for non-delivery, misdescription, defective supply or rights that cannot lawfully be waived. No automatic waiver is created just because digital delivery begins.
